If you have restricted the processing of your personal data, these data – with the exception of their archiving – may be processed only subject to your consent or to claim, exercise or defend legal entitlements or to protect the rights of other natural persons or legal entities or for important public interest reasons cited by the European Union or a member state of the EU.


Opposition to promotional emails

We hereby expressly prohibit the use of contact data published in the context of website legal notice requirements with regard to sending promotional and informational materials not expressly requested. We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1)(a) DSGVO. You may revoke your consent at any time. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed.

We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Any mandatory statutory provisions, especially those regarding mandatory data retention periods, remain unaffected by this provision.

Request by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass these data on without your consent.

The processing of these data is based on Art. 6 para. 1 lit. b GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent (Article 6 (1) a GDPR) and/or on our legitimate interests (Article 6 (1) (f) GDPR), since we have a legitimate interest in the effective processing of requests addressed to us.

The data sent by you to us via contact requests remain with us until you request us to delete, revoke your consent to the storage or the purpose for the data storage lapses (e.g. after completion of your request). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

Registration on this website

You can register on our website in order to access additional functions offered here. The input data will only be used for the purpose of using the respective site or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject your registration.

Processing of data (customer and contract data)

We collect, process, and use personal data only insofar as it is necessary to establish, or modify legal relationships with us (master data). This is done based on Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract. We collect, process and use your personal data when accessing our website (usage data) only to the extent required to enable you to access our service or to bill you for the same.

Collected customer data shall be deleted after completion of the order or termination of the business relationship. Legal retention periods remain unaffected.

Data transmitted when entering into a contract with online shops, retailers, and mail order
We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract, for example, to companies entrusted to deliver goods to your location or banks entrusted to process your payments. Your data will not be transmitted for any other purpose unless you have given your express permission to do so. Your data will not be disclosed to third parties for advertising purposes without your express consent.

4. Analytics and advertising


Google Analytics

This website uses Google Analytics, a web analytics service. It is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Google Analytics uses so-called "cookies". These are text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

Google Analytics cookies are stored based on Art. 6 (1) (f) DSGVO. The website operator has a legitimate interest in analyzing user behavior to optimize both its website and its advertising.

IP anonymization

We have activated the IP anonymization feature on this website. Your IP address will be shortened by Google within the European Union or other parties to the Agreement on the European Economic Area prior to transmission to the United States. Only in exceptional cases is the full IP address sent to a Google server in the US and shortened there. Outsourced data processing

We have entered into an agreement with Google for the outsourcing of our data processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Matomo

This website uses Matomo (formerly Piwik), an open source software programme designed for the statistical analysis of user activity on the site. Matomo uses ‘cookies’, small text files which may be stored on your computer and which permit analysis of your website use. The information we collect about your use of the services offered on this site is stored on a server located in Germany and will not be disclosed to any third party. After being processed, your IP address is immediately rendered into an anonymous form before being stored.

  • XING. Provider is the XING AG, Dammtorstraße 29-32, 20354 Hamburg, Germany.

We only use these plugins together with "Shariff". This application prevents the plugins integrated into our website from transferring data to the respective provider when the page is first accessed. Only when you activate the respective plugin (consent according to Art. 6 para. 1 lit. a DSGVO), a direct connection to the server of the provider is established. As soon as you activate the plugin, the respective provider receives the information that you have visited our site with your IP address. If you are simultaneously logged into your respective account (eg Xing, Twitter, Facebook, Pinterest), the respective provider can assign the visit to our pages to your user account.

 

5. Newsletter

Newsletter data

If you would like to receive our newsletter, we require a valid email address as well as information that allows us to verify that you are the owner of the specified email address and that you agree to receive this newsletter. No additional data is collected or is only collected on a voluntary basis. We only use this data to send the requested information and do not pass it on to third parties.

We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1) (a) DSGVO. You can revoke consent to the storage of your data and email address as well as their use for sending the newsletter at any time, e.g. through the "unsubscribe" link in the newsletter. The data processed before we receive your request may still be legally processed.

The data provided when registering for the newsletter will be used to distribute the newsletter until you cancel your subscription when said data will be deleted. Data we have stored for other purposes (e.g. email addresses for the members area) remain unaffected.

 

6. Plugins and tools

YouTube

Our website uses plugins from YouTube, which is operated by Google. The operator of the pages is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

Furthermore, YouTube will be able to place various cookies on your device. With the assistance of these cookies, YouTube will be able to obtain information about our website visitor. Among other things, this information will be used to generate video statistics with the aim of improving the user friendliness of the site and to prevent attempts to commit fraud. This website embeds videos via Vimeo.com, a service of Vimeo, Inc., 555 West 18th Street New York, New York 10011, USA ("Vimeo"). In addition, Vimeo may place cookies on your device. Furthermore, Vimeo enables the use of certain additional functions, such as rating or sharing videos. As a content provider, it is responsible under general legal provisions for its “own content” that it makes available for use. 7. Data Protection Declaration for Job Applications  

We encourage anyone who is interested in working for us to submit applications. Below you will find information on the scope, purpose and use of the personal data we collect from candidates in conjunction with such applications. We assure you that we shall collect, process and use your data only in compliance with the applicable data protection provisions and all other statutory obligations and that your data will be treated as strictly confidential information.

Data Collection Scope and Purpose 

Whenever you submit an application to us, we will subsequently process your related personal data (e.g. contract and communications data, application documents, notes taken during applicant interviews, etc.) if this is necessary to make a decision on the establishment of an employment relationship. The legal foundations for these activities are § 26 of the new German Federal Data Protection Act (BDSG-neu), Art. 6 Sect. 1 lit. b GDPR (Contract Negotiations) and – provided you have consented to these activities – Art. 6 Sect. 1 lit. a GDPR. If you have given your consent, you have the right to revoke it at any time.  

Within our company, your personal data will be shared only with individuals who are involved in the processing of your application. Your data shall not be shared with any other third parties unless you have given us your express consent to do so.  

If your application results in your recruitment, the data you have submitted will be stored in our data processing systems based on § 26 of the new German Federal Data Protection Act (BDSG), Art. 6 Sect. 1 lit. b GDPR for the purpose of establishing the employment relationship. 

Data Archiving Time  

If we should not be able to offer you a position with us, or if you reject an offer we have made to you, or retract your application, revoke your consent to data processing or ask that we delete your data, we shall store or retain your data incl. any remaining physical application documents for a period of 6 months after the conclusion of the application process, to enable us to reconstruct the developments of the application process in the event of disagreements (Art. 6 Abs. 1 lit. f GDPR). YOU HAVE THE RIGHT TO OBJECT TO SUCH ARCHIVING IF YOU HAVE LEGITIMATE INTERESTS THAT OUTWEIGH OUR INTERESTS.  

The data shall be deleted once the 6-month-retention-period has ended, unless a statutory retention mandate or any other legal grounds compel us to continue to store the data. If it should be foreseeable that the data will still have to be stored upon expiration of the 6-month-retention-period (e.g. because of imminent or pending litigation), the data shall not be eradicated until the data has become irrelevant. This shall be without prejudice to any other retention mandates.
